Terms of Service
These terms govern your use of the EnqLayer website and service, provided by CONRAD & THOMAS LTD (“EnqLayer”, “we”, “us”), a company registered in Scotland. By using the site or the service, you agree to these terms.
Early access. EnqLayer is a new, actively developing product. Some capabilities are delivered with assisted setup, and self-serve connectors are on our roadmap. We describe what is available today honestly and do not claim features that are not yet live.
1. The service
EnqLayer is an AI enquiry operations layer for service businesses. It captures enquiries from the channels you connect, uses AI to draft suggested replies in your voice, and holds each draft for your approval before anything is sent. The service is a tool to assist your team — it does not replace your judgement.
Human approval by design. EnqLayer operates a 0 auto-sent rule: no substantive reply is sent to your customer without a person approving it. You remain responsible for the messages you approve and send.
2. Eligibility & accounts
You must be at least 18 and authorised to act for your business. Keep your account credentials secure; you are responsible for activity under your account.
3. Pricing & payment
- All prices shown are estimated and confirmed before you pay. We will not charge you a figure you have not seen and agreed.
- The Enquiry Leak Audit is a one-off entry product and is creditable toward setup if you proceed within the stated window.
- Subscriptions are billed monthly on a month-to-month basis unless agreed otherwise in writing.
- Setup, usage-based items (such as SMS, WhatsApp or voice) and add-ons are billed separately and made clear before purchase. We do not sell “unlimited” messaging.
- Prices exclude VAT unless stated. Late or failed payments may pause the service after notice.
4. Acceptable use
You agree not to use EnqLayer to send unlawful, misleading, harassing or spam communications, to breach anyone’s rights, or to attempt to disrupt or reverse-engineer the service. You are responsible for complying with laws that apply to your communications, including marketing and privacy rules.
5. Your responsibilities
- Review and approve drafts before they are sent — you decide what goes to your customer.
- Ensure the information you give us (prices, services, tone, knowledge base) is accurate.
- Where you are the controller of your customers’ data, ensure you have a lawful basis to process it. Our data-processing terms are set out in the Privacy Policy.
6. AI limitations
AI-generated drafts can contain errors or omissions. They are suggestions, not advice. EnqLayer does not provide medical, legal or financial advice, and its output must not be relied on as such. Because a human approves every reply, you are the final check before anything reaches your customer.
7. Intellectual property
We retain all rights in the EnqLayer platform, brand and materials. You retain all rights in your own content and customer data. You grant us the limited rights needed to provide the service to you.
8. Data protection
Our handling of personal data is described in the Privacy Policy. For enquiry data we process on your behalf, we act as your processor under a data-processing agreement.
9. Disclaimers
The service is provided on a reasonable-efforts basis. To the extent permitted by law, we exclude implied warranties and do not guarantee specific business outcomes, revenue, or uninterrupted availability. Nothing in these terms excludes liability that cannot lawfully be excluded.
10. Limitation of liability
To the extent permitted by law, we are not liable for indirect or consequential loss, or for loss of profits, revenue or goodwill. Our total liability in any 12-month period is limited to the fees you paid us in that period. This does not limit liability for death or personal injury caused by negligence, fraud, or anything else that cannot be limited by law.
11. Termination
You may cancel at the end of your current month. We may suspend or end the service for breach of these terms, or on reasonable notice. On termination, we will delete or return data we hold as your processor, as set out in the Privacy Policy.
12. Governing law
These terms are governed by the law of Scotland, and the courts of Scotland have jurisdiction, without affecting statutory rights you may have where you live.
13. Changes
We may update these terms as the service develops. We’ll change the “last updated” date and, for material changes, take reasonable steps to notify you.
